Tenant Fees Toolkit launched by ARLA Propertymark.
The Association of Residential Letting Agents (ARLA Propertymark) have launched a 10-element tool kit for agents ahead of the fees ban on June 1.
The banning act is in place to prohibit landlords and letting agents from asking tenants for certain payments to be made or certain other steps to be taken. The guidance has been published to help inform agents and landlords of their rights and obligations under the legislation.
The kit includes a tenant guide, a case study from a Scottish letting agent looking at how the ban was handled north of the border, and what ARLA calls “practical tips to help agents deal with the loss of income.” It also includes a set of templates including an updated tenancy agreement with Tenant Fees Act compliant sections on default fees and a new deposit clause. 
“The toolkit will help our members comply with the ban; giving them practical tools and materials to operate in a post-tenant-fees world. With less than 40 working days to go until the ban comes into effect, agents need to ensure they’re compliant with the law, and both landlords and tenants understand what it means for them” says David Cox, ARLA’s chief executive.
Members will also have access to new Fee Templates, and a template Variation of Contract to use during the transition period that will incorporate fees into existing ASTs. For Holding Deposits, there are template letters for when they need to be refunded when it is forfeited, for transferring it into the first month’s rent and for when agents need more than 15 days to get everything sorted.
David Cox, Chief Executive of ARLA Propertymark also stated: “With less than 40 working days to go until the ban comes into effect, agents need to ensure they’re compliant with the law, and both landlords and tenants understand what it means for them.”
The Tenant Fees Toolkit, which is available to all ARLA Propertymark members from 2 April 2019 contains:
  • Ten factsheets covering all aspects of the ban
  • A series of 18 short films looking at specific issues
  • A simple Tenant Guide
  • A case study from a Scottish letting agent looking at how they dealt with their ban
  • Practical tips to help agents deal with the loss of income
